After receiving notice of Weight Watchers' New York state lawsuit (see August 6 blog entry below), CoolBrands has filed a lawsuit of its own. The Weight Watchers brand licensee of Smart Ones frozen food has filed a lawsuit in New York Supreme Court in Nassau County against Weight Watchers International and Wells Dairy for tortious interference with CoolBrands' business. CoolBrands alleged that Weight Watchers entered into a license agreement with Wells Dairy on July 28, 2004, in breach of its license agreement with CoolBrands, and that the companies conspired to deprive CoolBrands of opportunities during the remaining term of the license agreement. CoolBrands seeks $360 million in damages. A copy of the the complaint is available here.
