Despite the plaintiffs' recent victory in their Fair Labor Standards Act class action lawsuit against Pizza Hut, it seems that less than 10 percent of the eligible class members joined the litigation. In May, the court granted conditional class certification to a class of Pizza Hut restaurant general managers. The claims under the FLSA asserted that Pizza Hut improperly classified these employees as exempt from receiving overtime pay. According to this article in PizzaMarketplace.com, Pizza Hut intends to challenge the class certification once the certification discovery is completed.
